Violations

According to the provision of Section 27(1) of Act No. 474/2013 Coll. on Toll Collection for the Use of Specified Road Sections and on amending and supplementing certain acts as amended (hereinafter referred to as the “Toll Collection Act”), a violation on a specified road section is committed by a person who:

a) Uses the specified road sections in a vehicle without paying tolls.

b) Refuses to pay the toll after being requested by the persons authorised for enforcement at the location and the time of the check.

c) During use of the Specified Road Sections with a zero toll rate does not have an OBU in the vehicle.

d) Manipulates the OBU without authorisation and makes unauthorised interventions with the OBU.

e) Places the OBU in the vehicle or uses it in contradiction with the provision of Section 9(2) (a) and (b) of the Toll Collection Act.

f) Fails to enter correct and complete technical data about the vehicle needed for the toll calculation and debiting in the OBU, which results in toll arrears.

g) Provides incorrect or incomplete data for the toll calculation in a substitute manner according to the provision of Section 6 of the Toll Collection Act.

h) Fails to submit at the Police Officer's request:

1.      A document about the vehicle that allows the vehicle's technical data to be determined or verified.

2.      A toll payment confirmation according to the provision of Section 6(7) of the Toll Collection Act.

i) Fails to make the data in the OBU available to the Police Officer or the person authorised for enforcement.

j) Fails to notify of a change in the registered data according to the provision of Section 9(2)(c) of the Toll Collection Act.

k) Issues, changes or forges a document issued for the needs of assessing the compliance, suitability or other purposes of supervision over the assessment according to the provision of Section 22 of the Toll Collection Act without authorisation.

 

Administrative offences

According to the provision of Section 28(1) of Act No. 474/2013 Coll. on Toll Collection for the Use of Specified Road Sections and on amending and supplementing certain acts as amended (hereinafter referred to as the “Toll Collection Act”), an administrative offence on a specified road section is committed by a vehicle operator who:

a) Uses the specified road sections in a vehicle without paying tolls.

b) During the use of the specified road sections with a zero toll rate did not have an OBU in the vehicle.

c) Places the OBU in the vehicle or uses it contradictory to the provision of Section 9(2) (a) or (b) of the Toll Collection Act.

d) fails to notify of the change in the registered data according to the provision of Section 9(2)(c) of the Toll Collection Act.

 

The administrative offences according to Section 28(1) of the Toll collection Act shall be handled by the District Authority within the borough where the Vehicle Operator has the registered office if it is a legal entity, the place of business if it is a natural person – entrepreneur, or a residence if it is a natural person. If the Vehicle Operator is a person with the residence, place of business or registered office outside of the territory of the Slovak Republic, the local authority competent to lead the proceedings on the administration offence shall be the District Authority in the borough of which the violation of the liability according to the provision of Section 28(1) of the Toll Collection Act occurred.

For the aforesaid violations and administrative offences the amount of fines shall be imposed pursuant to provision of Section 27(1) and Section28(1) of Act No. 474/2013 Coll. on Toll Collection for the Use of Specified Road Sections and on amending and supplementing certain acts as amended.
