Under the Contract on the Use of Specified Road Sections the Vehicle Operator and/or Vehicle driver shall:

The Contract on the Use of Specified Road Sections shall also expire (in the relevant section involving the vehicle) if a period of 6 months since the recording of the last toll transaction by the OBU has expired  (General Business Terms and Conditions of the Toll Collection Administrator, Article 4, section 4.3, item 1).

If the OBU is not returned within the deadline specified above, the Vehicle Operator shall pay to the System Operator the contractual penalty in the amount of the acquisition price of the OBU and its accessories calculated by the amount of the Deposit provided as a security for the obligation of returning the OBU.

By returning the OBU as soon as possible (e.g., when leaving the country, assuming that they will not use the OBU for a longer period of time, etc.), Vehicle Operators can avoid:

  • Expenses related to the return of the OBU to the System Operator;
  • The contractual penalty for not returning the OBU.

Under the Prepaid Toll mode the Vehicle Operator and/or Vehicle Driver may return the OBU at any Contact or Distribution Point.

Under the Postpaid toll mode the Vehicle Operator or Vehicle Operator's authorised representative may return the OBU based on the submitted written power of attorney with officially attested signature that may not be older than 3 months only at a Contact Point.

A Guarantee is refunded to the Vehicle Operator or Vehicle Operator’s authorised representative and/or Vehicle Driver when returning the OBU, provided that the OBU is undamaged and fully functional. The deposit for the return of On-Board Units that are linked to a single Contract on the Provision of the On-Board Unit entered into under the Post-Pay Mode shall be refunded to the Vehicle Operator by a wire transfer to the Vehicle Operator's bank account specified in the Contract on the Provision of the On-Board Unit or in an addendum to the Contract on the Provision of the On-Board Unit or in a duly completed Request for Refund form delivered to the System Operator. If the amount that the System Operator is obliged to refund exceeds €100, the guarantee for the OBU will be refunded to the Vehicle Operator’s bank account stated in the Request for Money Refund that the Vehicle Operator is obliged to fill in.

If the Vehicle Operator and/or Vehicle Driver fail to return the OBU or if the OBU is lost or stolen, the System Operator is entitled to claim a contractual fine in the amount of the OBU acquisition price and the price of its accessories less the amount of the paid guarantee.

If the Vehicle Operator and/or Vehicle Driver damages or liquidates the OBU, the System Operator is entitled to exercise the claim for the guarantee and the contractual fine according to the current tariff of fees.

If the Vehicle Operator and/or Vehicle Driver fail to return the accessories for the OBU or part of them, the System Operator is entitled to decrease the amount of the guarantee refunded by the price of the accessories for the OBU according to the current tariff of fees.

If the Vehicle Operator and/or Vehicle Driver fail to return the OBU, including batteries and/or batteries' cover, the OBU is deemed damaged and the System Operator is entitled to reduce the amount of the guarantee refunded by the fee for the damaged OBU according to the current tariff of fees.

If there is a change of the Operator of a vehicle to which the OBU was provided, the original Vehicle Operator is obliged to return the OBU within 5 calendar days from such change.
