Obligations of the Vehicle Operator and the Vehicle Driver

One of the basic obligations of the Vehicle Operator and / or the Vehicle Driver is to register in the electronic toll system the technical data of the vehicle necessary for the calculation and its billing, data of the Vehicle Operator and their adjustments in accordance with the vehicle registration certificate according to a specific regulation or in accordance with the vehicle registration certificate issued abroad. Registration of a vehicle in the electronic toll system is achieved through the conclusion of the Contract on the Use of the Specified Road Sections, while exactly based on this Contract concluded with the Toll Collection Administrator the right of the Vehicle Operator arises to use the specified road sections with electronic toll collection.

Who can register a vehicle into the electronic toll system

Under the prepaid toll mode, the Contract on the Use of the Specified Road Sections can be concluded by the Vehicle Operator, its authorised representative and / or the Vehicle Driver.
Under the postpaid toll mode, the Contract for the Use of the Specified Road Sections can be concluded by the Vehicle Operator or its authorised representative.

What documents and data are required when registering a vehicle

Persons authorised to enter into the Contract on the Use of the Specified Road Section shall be required, at the request of the System Operator, to submit for verification of the registration data and the conclusion of the Contract on the Use of the Specified Road Sections:

  • the vehicle technical registration certificate or the vehicle registration certificate;
  • a valid ID or passport or a similar document certifying identity;
  • a valid driver's license;
  • an extract from the companies register or a similar register or a written power of attorney to represent the Vehicle Operator with an officially certified signature.

 

The System Operator shall be entitled for registration purposes to require the following information:

  • business name and address of the place of business, if the vehicle operator is a natural person - entrepreneur;
  • name, surname, date of birth, address, nationality, identity card or passport number, if the vehicle operator is other natural person;
  • name and business name and registered office, if the vehicle operator is a legal entity;
  • name and surname, date of birth, nationality and home address of the vehicle driver or an authorized representative of the vehicle operator;
  • ID card or passport number of the vehicle driver or its authorised representative and the driver's license number of the vehicle driver;
  • ID number of the vehicle operator, if assigned, or the equivalent data corresponding to another country;
  • tax ID number of the vehicle operator (if assigned);
  • registration data of the vehicle operator in the companies register or a similar register, if registered in such register;
  • vehicle license plate number and country where the vehicle is registered;
  • the vehicle category, the maximum total permissible weight of a vehicle, the number of axles and the vehicle emission class;
  • an indication of whether the vehicle is equipped with a device or a modification that could prevent the correct functioning of the OBU (e.g. metal coated wind shield);
  • the estimated total length of specified road sections to be driven by the vehicle on a single journey on the specified road sections or the estimated total length of the distance driven during a limited period of time in repeated use of the specified road sections;
  • vehicle operator's banking details;
  • vehicle operator's contact details;

Where can a vehicle be registered

The Contract on the Use of the Specified Road Sections under the prepaid toll regime (in which you can use the Specified Road Sections only on the basis of prior payment / pre-payment of the toll) can be concluded by the Vehicle Operator, its authorized representative and / or the Vehicle Driver, namely at any Contact or Distribution Point. The Contract for the Use of the Specified Road Sections under the prepaid mode is concluded exclusively for one registered vehicle.

The Contract on the Use of the Specified Road Sections under the postpaid mode can be concluded by the Vehicle Operator or its authorised representative:

  • at a Contact Point;
  • or through the fleet card issuers.

 

The Contract on the Use of the Specified Road sections under the postpaidmode can be concluded for several registered vehicles, where the Vehicle Operator is required to provide a security for the toll payment liability in the form of a bank guarantee or a cash deposit or through a fuel card issuer.

When can I start to use the specified road sections

The vehicle can start to use the specified road sections when all the obligations of the vehicle operator and/or the driver of the vehicle are specified by Act no. 474/2013 Coll. on Toll Collection for the Use of the Specified Road Sections and on amending and supplementing certain acts as amended (hereinafter referred to as "Act No. 474/2013 Coll. on Toll Collection), and when:

  • the Contract on the Use of the Specified Road Sections has been concluded in a valid and effective manner;
  • the Contract on the Provision of the On-Board Unit has been concluded in a valid and effective manner;
  • an OBU is placed, installed and commissioned in the Vehicle, including its accessories, and it is used in accordance with Act No. 474/2013 Coll. on Toll Collection and in the manner that enables generation of data necessary for toll collection and enforcement;
  • in the OBU the number of axles of the vehicle is set to correspond to the actual condition of the vehicle.

All rights and obligations of the vehicle operators, the vehicle drivers and, where applicable, authorised persons concerning the contracts and the registration shall be governed by the relevant provisions of the General Business Terms and Conditions of the System Operator and the General Business Terms and Conditions of the Toll Collection Administrator, as well as the relevant provisions of Act No. 474/2013 Coll. on Toll Collection for the Use of the Specified Road Sections and on amending and supplementing certain acts as amended.
